The Supreme Public Prosecutor's Office is the top member of the public prosecutor's office system. In accordance with the law, it performs methodological, control and management activities. Pursuant to Article 80 para. 1 of the Constitution of the Czech Republic, the Public Prosecutor's Office represents a public lawsuit in criminal proceedings, while its status and competence are determined by law. The public prosecutor supervises the legality of the preparatory criminal proceedings and represents the prosecution in the main trial, presents evidence and proposes punishment. The Supreme Public Prosecutor's Office is located at Jezuitská 585/4, Brno.
Supreme State Prosecutor:
- is the top member of the public prosecutor's office system
- performs methodological, control and management activities in accordance with the law
- protect the public interest in accordance with the law, independently, impartially and effectively
- supervises the legality of the preparatory criminal proceedings
- represents a public action in criminal proceedings and performs other tasks, if so provided by law
- the position and competence of the Public Prosecutor's Office is determined by law
- protects the public interest in a number of other non-criminal proceedings.
Public prosecutor:
- supervises the legality of preparatory criminal proceedings
- in the main trial, represents the prosecution, presents evidence and proposes punishment
- the special powers of the Attorney General (appeal, cassation rights) contribute to the achievement of justice in criminal proceedings
- the Attorney General may also intervene in favor of the protection of the public interest by administrative action.
